Defense Makes Closing Arguments, "There is No Evidence."

-Defense Attorney Jim Koby warned the jury against convicting an innocent man, telling the panel Koula isn?t capable of killing his parents.

Koby said, ?There is no forensic evidence linking Eric to these crimes. There are no fingerprints, we know there is no DNA, we know there is no murder weapon, we know there are no witnesses.?

According to Koula, he had just finished grouting a North Side bathroom before shopping at two Shopkos for his wife?s anniversary present. He is not on video from the La Crosse store but supports his alibi with a receipt from the Onalaska location.

Koby argued Koula was at the North Side home until about 5:30 p.m., eliminating the opportunity to kill his mother at 5:41 p.m. when her computer recorded its last keystroke.

Koby also stated that the only thing the state proved was there was no forensic evidence, Eric had a good relationship with his father, and the timeline doesn?t work.

He said that the state had not done a thorough job on finding the real killers by not testing certain elements that were discovered in the investigation. Koby said, ?Our investigation is ongoing.?

He also argued that Eric had sent the note because he was grieving and dealing with the loss of his parents so he ?wasn?t thinking clearly.?

Koby also went on to say that, when it came to money, there, ?was no desperation.?

Koby then posed the question, ?If he had other options to get money. If he could have asked his in-laws for money, which he did, would it make sense for him to go and blow his parents head off??
