Spencer Man Loses Fight Against Lifetime Firearm Ban

-A state appeals court rejected a Spencer man's claim that a lifetime ban on firearms possession violates his constitutional rights.

Daniel Lee Rueden Jr. said the ban should not continue because he wasn't convicted of a violent felony.

Judge Paul Lundsten decided to uphold the decision by Clark County Circuit Judge Frederick Fleishauer.

The District 4 Court of Appeals concluded that the state may impose a lifetime ban on Ruden and other felons because it is "substantially related to an important governmental interest.?

Rueden's prior felony conviction stemmed from his stealing an employer's El Camino automobile and a license.

In March 2010, stole a handgun belonging to his ex-wife's uncle and offered to sell it to a woman who was cooperating with police. Rueden was arrested and charged with a felon in possession.

After pleading guilty to the charge, Fleishauer sentenced Rueden in November 2010 to nine months in jail and the lifetime ban commenced.
