Eau Claire Man Shot at by Police Sentenced in Eau Claire County Court

(WEAU Staff, WEAU) An Eau Claire man who was shot at by Eau Claire police after they saw him point at gun at them during a disturbance is sentenced.

A sentencing hearing took place Wednesday in Eau Claire County Circuit Court Wednesday for 54-year-old Thomas Burback. According to online court records, Burback was found guilty due to no contest plea to one count of failure to comply with officer’s attempt to take person into custody, and one count of possession of a firearm while intoxicated.

The remaining charges were dismissed and read in. Online court records show on Wednesday Burback was sentenced to 1 1/2 years in prison, 2 years extended supervision, and 1 year probation.

The incident happened in May of 2024. Authorities said officer Ariana Down Larson confronted Thomas Burback of Eau Claire after responding to a report of a disturbance. Eau Claire police say she shot twice at Burback when he pointed a revolver style handgun at her.

He had a gunshot graze on his back and was treated for his injuries. A few months later in October 2024, the Eau Claire County District Attorney found the officer’s actions were appropriate and necessary.
