Man Involved in Eau Claire Shooting Incident Enters Plea

(WEAU Staff, WEAU) A man who was arrested in an officer-involved shooting in Eau Claire entered a plea in court on Tuesday.
According to WEAU Staff, Eau Claire police say Officer Down Larson confronted Thomas Burback after responding to a report of a disturbance. While Officer Down Larson was being questioned during the preliminary hearing back in August, the defense questioned her on her belief that Burback was holding a firearm when she shot her gun.
Larson responded by saying she knew that Burback was still holding a gun. During Burback’s court appearance on Tuesday, he was found guilty of, due to a no contest plea, failure to comply with officer’s attempt to take a person into custody and possession of a firearm while intoxicated.
Two other charges were dismissed and read in. A pre-sentencing investigation was ordered, but a sentencing date hasn’t been set at this time. Burback had been scheduled for a jury trial at the end of the month, but that was removed from the calendar.
