Fond du Lac County District Attorney to Serve as Special Prosecutor in Wausau Ballot Drop Box Case

Marathon County District Attorney Kyle R. Mayo announced that due to conflicts of interest and to ensure full transparency and impartiality, DA Mayo requested the appointment of a special prosecutor in the ballot drop box case.

Fond du Lac County District Attorney Eric Toney has agreed to serve as Special Prosecutor in the Wisconsin Department of Justice Division of Criminal Investigation (DCI) investigation concerning the removal of a drop box in the City of Wausau on September 22, 2024.

As Special Prosecutor, DA Toney will review DCI’s investigation, determine whether additional investigation is needed, and make any appropriate determinations related to the investigation.

The investigation remains active and ongoing with possible follow up investigative efforts needed. As a result, no further details will be released at this time and any future inquiries should be submitted to the special prosecutor.

District Attorney Toney stated “anyone referenced in the investigative materials is presumed innocent unless and until proven guilty.”
