A homicide charge has been amended to a misdemeanor for a Warrens man accused in a collision that killed a woman on an all-terrain vehicle and injured a toddler in Jackson County.District Attorney Gerald Fox says evidence shows the fatal crash would have happened even if Phillip Holloway wasn't intoxicated.
A felony charge of homicide by intoxicated use of a vehicle was amended to a misdemeanor OWI. Another charge of causing injury while intoxicated was also amended to misdemeanor for the 23-year-old Warrens man.
Sixty-year-old Karen Gibson was driving an ATV on Highway O in the Town of Knapp last August. Holloway says he slammed on his brakes, but Gibson was looking behind her and never saw his vehicle. Gibson died at the scene. A 3-year-old child riding on the ATV was treated for minor injuries.
