Man Arrested in Officer Involved Shooting in Eau Claire Appears in Court

(WEAU Staff, WEAU) A man who was arrested in an officer-involved shooting in Eau Claire appeared in court.
According to WEAU Staff, 53-year-old Thomas Burback is charged with pointing a firearm at an officer, failing to comply with an officer and other charges. Eau Claire police say Officer Down Larson confronted Burback after responding to a report of a disturbance.
While Officer Down Larson was being questioned during the preliminary hearing back in August, the defense questioned her on her belief that Burback was holding a firearm when she shot her gun. Larson responded by saying she knew that Burback was still holding a gun.
Burback is facing charges of intentionally pointing a firearm at law enforcement, failure to comply with officer’s attempt to take person into custody, possession of a firearm while intoxicated, and disorderly conduct.
During his arraignment, he pleaded not guilty to the charges. He’s scheduled for a four day jury trial in February.
