COURT RULES IN FAVOR OF SUBDIVISION MORATORIUM

A state appeals court ruling justifies a strict moratorium on subdivisions in the Town of Pine Valley.The Court of Appeals rejected arguments by the Wisconsin Realtors Association and the Wisconsin Builders Association in a case involving the Town of West Point in Columbia County. They say Wisconsin towns can temporarily block new development.
Facing growth pressures last year, the Town of Pine Valley enacted a 2-year ban on the change of land use and the dividing of land.
Other municipalities are considering moratoriums to offset a rush of development expected before a 2010 deadline for the approval of comprehensive plans.
Real estate interests say such plans are illegal.
