Supreme Court to Hear OWI Case on Thursday
Thursday, October 6th, 2022 -- 1:00 PM
(Raymond Neupert, WRN) The State Supreme Court is set to hear oral arguments on an OWI case from Central Wisconsin.
A Marathon County man convicted of 8th time O W I is challenging the manner of his April 2018 arrest. Police were looking for a person erratically driving a Harley Davidson motorcycle, and Charles Richey was located a short distance away while also driving a Harley.
Richey failed blood tests after refusing to take a breath test. He pleaded guilty in 2020, and appealed, saying that there was no reasonable suspicion to stop him just because he was driving a Harley. Police say it was a reasonable inference and both the circuit court and the appeals court agreed.
