JACKSON CO. OFFICERS CLEARED IN SHOOTING

--The Wisconsin Department of Justice, Division of Criminal Investigation has determined two Jackson County Sheriff?s deputies were justified in the shooting death of a Hatfield-area man and only shot the man as a ?last resort?.36-year-old Shane Jacoby was shot after a confrontation with Clark and Jackson County officers on November 29th.
In a memorandum issued Friday, Clark County District Attorney Darwin Zwieg says the investigation found Chief Deputy Jamie Guttenberg (GOO-tun-berg) and Lieutenant Rob Stapel, both of the Jackson County Sheriff?s Department, ?exercised remarkable restraint? throughout the incident.
The report says Soyk was the first on the scene after a passerby called 9-1-1 reporting he?d been involved in an altercation with Jacoby, who was walking down the middle of Riviera Avenue outside of Hatfield.
The report indicates Jacoby went into a ?crouched shooting stance? and aimed a firearm at Soyk. Though Soyk feared for his life and drew his weapon, he did not fire while Jacoby was still pointing his gun at him.
The report indicates both Clark and Jackson County officers yelled and pleaded with Jacoby to put down his weapon as a foot chase ensued. Jacoby shot the weapon multiple times.
Officers also restrained from shooting Jacoby when he tried gaining entrance to a home by shooting the front door.
The confrontation ultimately ended when Soyk says he heard an officer yell that Jacoby was raising his arm, in an apparent attempt to shoot at officers.
Zwieg says both officers have extensive military and law enforcement backgrounds.
