Athens Man Sentenced for Sexual Assault

Wednesday, June 5th, 2019 -- 11:08 AM

(Wausau Daily Herald) -An Athens man convicted of sexually assaulting a woman with Alzheimer’s in a Rothschild assisted living home will spend three years in prison.

John Niemann, 57, also will serve four years on extended supervision. During a Tuesday sentencing hearing, Marathon County Circuit Judge Gregory Strasser also ordered Niemann to register as a sex offender for life and prohibited him from visiting any nursing or assisted living homes. Niemann pleaded no contest and was convicted in March of second-degree sexual assault.

According to a criminal complaint, Niemann was at Copperleaf Memory Care in February 2018, visiting his wife, when two workers found him naked in bed and in a sexual position with another resident. The victim has Alzheimer’s and was unable to consent to sexual activity. Her doctor declared her incompetent in April 2017, according to the complaint.
