Spokesman Nick Jarmuz says you don't have to be holding your cellphone to get distracted while driving.
"Whether it's a conversation over a speakerphone, or something else. Maybe even talking with a passenger in the car."
Jarmuz says there's plenty of distractions.
"Anything that takes your attention off the road puts yourself and everyone else sharing the road with you in danger."
Jarmuz says the problem isn't holding the cell phone, it's using it at all.
"It really doesn't matter if you're holding the phone to your ear or talking on a speaker phone. It's the conversation that's causing the mental distraction and taking your attention off the road."
He says that there's plenty of other potential distractions, like eating or drinking, talking with passengers, or messing around with your radio.
