Clark County Sheriff's Department Revisits the Implement of Husbandry Law and Weight Restrictions

-With spring upon us, the Clark County Sheriff’s Department is re-visiting the Implement of Husbandry Law and weight restrictions placed on roads.It has always been and will remain the goal of the Clark County Sheriff’s Office to gain compliance with weight restrictions and limit road damage with education and thorough investigations. When the Sheriff’s Office is made aware of a possible violation, they will, as always, thoroughly investigate the allegation through a proper investigation. This usually includes pictures of any evidence of road damage and any other property damage. The violator will be given measures to take on corrective actions to come into compliance and prevent future violations. This applies to all industries not just the farming industry. In the event there is road damage, this information will then be turned over to the maintaining authority of the road (state, county, city, village or township). The repairs of the roadway are a civil matter, not a crime. It is left up to the maintaining authority to seek compensation for any damage that may have occurred. The Sheriff's Department seeks compliance with these laws through education and awareness.
For years the Sheriff’s Office has worked side-by-side with the trucking and farming industry in Clark County. Together they have formed an excellent working relationship and mutual respect for each other. In the past and up to today, everyone whom the department contacts in reference to weight violations has complied and worked with them. The Sheriff’s Office and State Patrol both investigate weight violation and the State Patrol’s enforcement action may vary from the Sheriff's Department.
