Black River Falls Man Found Incompetent for Drunk Driving Accident

-A Black River Falls man accused of drunk driving and hitting a Merillan man appeared in Jackson County Court on Monday for a competency hearing.

According to the Jackson County Sheriff's Department, the accident happened around 9pm on U.S. Highway 12/27 near the westbound ramp of I-94. The department said that Dean Brown was walking home from work when he was struck by Joseph Cholka of Black River Falls. Brown had injuries to his face, mouth and leg.

Cholka was arrested and charged for his 5th OWI. He was also charged with bail jumping and operating after revocation among other charges. He appeared in court for a competency hearing on Monday. This is the 2nd one he's had with the first occurring back in October of 2015. It was said at that time that he could regain his competency, so the 2nd test was held. However, the results were the same as the first and Cholka was found to be incompetent, but the state did ask that the case remain open and a status conference was set for May.
