Former Memorial Medical Center Employee Charged with Sexually Assaulting Two Patients

Thursday, February 4th, 2016 -- 11:51 AM

-A former hospital employee has been charged with sexual assault.

42-year-old Randy Magnus of Neillsville, who was employed as a male nurse at Memorial Medical Center, has been charged with 2 counts of 2nd degree sexual assault of an intoxicated victim and 2 counts of 2nd degree sexual assault of an unconscious victim.

According to the criminal complaint, there were two victims in this matter. In one instance, which occurred in July of 2015, the victim had come into the emergency room after suffering a seizure. She was very tired and groggy, which is a common after a seizure. She said that while she was being examined, she was left alone with the male nurse, Magnus, and he put his hand down her shorts and penetrated her. She also stated that he used a vibrating tool on her as well. She also stated that she was assaulted by him when she used the bathroom. The doctor's report noted that even though the victim was groggy, she was responding to commands and was aware of person, place and time.

The 2nd incident occurred in August. The other victim in this matter was suffering from migraine headaches. She was given medicine to help with the migraines and they made her groggy, but she remembered a male nurse being in the room. When she awoke later, she discovered that the button on her shorts was undone and the zipper was down slightly. She also noticed that her underwear was pushed aside. Again, the doctor's report noted that even though the victim was groggy, she was responding to commands and was aware of person, place and time.

Magnus was the male nurse on duty during the times the two incidents occurred. He initially denied having any contact or being alone with the first victim and stated that he made a comment about the 2nd victim having smooth legs, which she said in her statement, and admitted that in order to help her, he gave her a massage to ease the pain and rubbed her stomach to help with some stomach discomfort that she was having. The victim did admit that he had pressed on the area where she was having a headache, but didn't even know he was rubbing her stomach.

After his interview with the authorities and MMC's CEO, Magnus went back to the CEO and stated that he hadn't told them everything in the initial interview because he didn't want to be handcuffed. He stated that with the first victim, he had only been alone with her while she went to the bathroom, but nothing happened and he did take her pulse in the groin area. In the 2nd incident, he stated that he did give the victim a massage and rub her stomach and that she grabbed his hand and pushed it into her shorts. Magnus was fired at that time, in August of 2015, for violating MMC's sexual harassment policy. The doctors that treated the victims at the time stated that there was no medical reason behind Magnus' contact with the victims and they were not recorded on the report.

The charges against Magnus have come as a result of the investigation by the Neillsville Police Department and Memorial Medical Center. Magnus has not been employed with Memorial Medical Center since August of 2015 as they take these allegations very seriously and strive to keep their patients, employees, volunteers and the community safe. Magnus will be in court in two weeks for his initial appearance.
