Fairchild Man Charged with Misconduct in Officer Appears in Court for a Motion Hearing

-A Fairchild man charged with misconduct in office appeared in Jackson County Court for a motion hearing on Friday.Phillip Hazard, who served as town clerk for the Town of Cleveland in Jackson County, is accused of calling his home a polling place during the 2015 spring election. Hazard was running for a supervisor position and the criminal complaint says there were biased results during the election.
Hazard's attorney filed for two motions. The first was to dismiss the case all together. Based on the arguments suggested, the judge felt a preliminary hearing would be better to discuss that particular motion. A 1 and ? day preliminary hearing was scheduled. The second was to have the Jackson County District Attorney recuse himself from the case due to the nature of it involving county matters. However, the judge felt there was no conflict and it would be up to the DA to recuse himself.
A $1,000 cash bond has been set for Hazard and he's not allowed to have any contact with ballots belonging to the Town of Cleveland.
