Civil Suit Involving Clark County Sheriff and County Law Enforcement Committee Continues

Monday, August 24th, 2015 -- 1:20 PM

-The Clark County Sheriff is still pursuing his case against the Clark County Law Enforcement Committee and the county board.

This saga began at the beginning of 2015 when Clark County Sheriff Greg Herrick purchased new vehicles for the department. He had money in his budget to do this, but he bought the vehicles without prior approval from the Law Enforcement Committee, which has always been done in the past. One of the vehicles he purchased was a Dodge Ram 1500 which he claimed his constituents told him to have in case he needed to respond to a call in the woods or a farmer's fields. The LEC then tried to keep the sheriff from taking possession of the truck because they felt, as did people in the county, that the sheriff used tax payer money to purchase a new vehicle for himself.

A civil suit was filed by the sheriff and both parties appeared in court in April. Judge Eagon Thomas called the case trivial and hoped the parties could reach an agreement before the next court date. He denied the sheriff's injunction, but also stated that the county was on the hook for the truck anyway and they shouldn't have the power to keep the truck from him. After that court date, the county board relented and allowed the sheriff to take possession of the truck.

However, the sheriff continued with his case, saying the LEC and county board were impeding his duties as Clark County Sheriff. The county filed a motion to dismiss the case, which was supposed to be heard on Thursday of last week, but the sheriff entered an amended complaint against the board earlier this month saying the LEC has since been malicious and vindictive in their decisions regarding his department and they're doing it to embarrass him. A future court date regarding this amended complaint has not been set at this time.
