Court of Appeals Judge Rules in Favor of Large Wood County Dairy Farm

(Wisconsin Ag Connection) -Opponents of a proposed large scale dairy farm in Wood County failed to have a local judge's decision appealed in an attempt to stop the project.

Last week, the District IV Court of Appeals upheld a circuit court decision ordering Saratoga officials to issue building permits for the Golden Sands Dairy, being built by the Wysocki Family.

In April 2013, the farm sued the town for violating the state's livestock siting law and exceeded its authority when it created a building-project moratorium after the farm was proposed. The Wysockis have been planning to build the Golden Sands Dairy since 2012. The concentrated animal feeding operation would sit on 7,000 acres and house 5,300 animals in the township.

Attorneys for the developers say they filed a civil case against the town because local officials delayed issuing permits for the project until the municipality implemented a moratorium on new buildings. Zoning board members then created an interim zoning ordinance, which the Wysockis felt was personal discrimination against the farm specifically. The town then appealed, saying the farm did not have a vested right in the building permit. But the court ruled last week that the seven building permits must be processed.
