-A Colby daycare owner charged with breaking the leg of a seven-month-old girl appeared in Clark County Court for a preliminary hearing on Monday.25-year-old Kaylee Schnitzler, who owns Dream Bound Daycare in Colby, was charged with Child Abuse and Child Neglect after an incident that occurred on October 9th of last year.
Prosecutors say the seven-month-old?s mother picked her and her three-year-old sister up from the daycare and noticed the girl?s left leg was in an odd position and swollen. After taking the girl to a doctor, she was told the leg was broken. After several interviews, Schnitzler did say that she noticed the girl?s leg was in an odd position and after she tried to adjust it she heard something snap.
Clark County District Attorney, Lindsey Boon-Brunette questioned the Colby-Abby Police Officer involved with the case, Jason Bauer. He said Schnitzler told him that she was the only one that watched the children and a doctor told him that the broken leg was an intentional act and not an accident.
Defense attorney John Stichert said that other than the inference of the DA and Officer Bauer, there?s no proof that Schnitzler broke the leg of the child. He said they were reaching a conclusion without the facts.
In the end, Judge John Counsell said it was a difficult situation because the victim couldn?t come out and tell them what happened and the evidence falls in the circumstantial range. However, he did feel there was probable cause and the court proceedings will continue.
