-A Marshfield man accused of punching his pregnant girlfriend in the stomach, dousing her in gasoline and threatening to start her on fire had a motion hearing in Wood County Court on Tuesday.During the hearing, Ress? attorney Damon Stichert made several motions to remove some of the charges against his client.
Stichert asked that the strangulation and attempted abortion charge be thrown out because Ress? victim recanted and he alleged that there was no physical evidence. Judge Nicholas Brazeau Jr. denied the motion saying that the defense was alleging that some of the charges were applicable meaning that the other two still were regardless of the recanting.
Next, Stichert asked that the intent to deliver heroin charge be dropped feeling that the DA was stretching the charges and that no evidence pointed to the intention to deliver by Ress. The judge denied that as well stating that particular charge should be brought up during the trial.
The final motion brought up by Stichert, was to bring in past events that allegedly occurred between Ress and his victim, regarding the frequent recants by the women involved, in order to establish credibility. Judge Brazeau did grant that request, but only if every piece of evidence was brought in from the past incidences.
Finally, the judge refused to lift the no contact agreement between Ress and the women he allegedly abused. Both wanted it lifted so Ress can see his child when it?s born. The judge refused, telling the women that he was doing it for her and her child?s safety.
