-A La Crosse man made an appearance in Marathon County Court on Tuesday. In March, Paige Metz of Loyal was killed when Tyler Deal allegedly lost control of his vehicle which then spun into a utility pole on the passenger side.
After state attorney Kala Strawn received clarification on a hearsay objection by defense attorney Joey Roeth, DA Strawn then told the court that the preliminary hearing could commence, but she would need a brief recess to procure the witness.
Roeth had no objections; however the witness could not be reached on time, so the preliminary hearing was rescheduled for the beginning of October.
Deal is being charged with homicide by intoxicated use of a vehicle, homicide by use of a vehicle, and homicide by negligent operation of a vehicle due to the death of Metz.
At first, only misdemeanor possession charges had been filed against him.
