Two area legislators have introduced legislation they say would reign in the state Attorney General’s nuisance law authority. Sen. Dave Zien (R/Eau Claire) and Rep. Scott Suder's bill has the support of the Wisconsin Farm Bureau, which says Wisconsin businesses need to be assured if they follow state and federal laws they won’t be sued as a nuisance. They point to a suit in Sawyer County where the Attorney General and out-of-state landowners filed a nuisance suit against a cranberry grower even though the cranberry grower has not been cited for any environmental violations by any regulatory agency. The Farm Bureau says farm families are concerned they could be sued by the Attorney General for being a nuisance for just for farming their land. The legislation introduced would prevent the Attorney General from bringing nuisance lawsuits against citizens and businesses that are not violating the law, joining private party lawsuits without the Governor of Legislature’s approval, or joining in a lawsuit commenced by another state without the Governor’s order.
