MORE LEGAL WRANGLING PREMISE REGISTRATION CASE

Wisconsin’s Department of Agriculture, through Clark County’s District Attorney, has filed another motion in a controversial court case.
Clark County Circuit Court Judge Jon Counsell dismissed a case against Emanuel Miller Jr. The local Amish farmer has refused to comply with the state’s mandatory premise registration law. He ruled the law infringed on Miller’s religious beliefs and wasn’t the “least restrictive” means to ensure a timely response to disease outbreak.
The state has filed a motion to reconsider. A hearing on that motion was canceled and hasn’t be rescheduled.
This week, the state filed a motion to submit a brief concerning the impacts of the termination of the National Animal Identification System (NAIS) on the state’s premise registration system.
According to the motion, the federal government scrapped NAIS after testimony in the Miller Jr. case had finished, but before Counsell issued his ruling. That development “greatly affects” the case, because the Amish were concerned Wisconsin’s law would lead to animal identification and tracking.
No future court dates have been set.
