AMISH WIN COURT BATTLE IN JACKSON CO.

As we wait for a decision in a pivotal Clark County court case involving the Amish, other members of that faith have won a legal battle in a neighboring county.

The Town of Albion had filed a complaint against Samuel Stolzfus and his wife Nancy claiming the couple failed to apply for a building permit.

Wisconsin law states one must obtain a building permit and agree to adhere to the state’s uniform dwelling code. Stolzfus claimed he could not sign the application because he didn’t know if he could adhere to the codes.

After more than two years of litigation, Jackson County Circuit Court Judge Thomas Lister dismissed the case earlier this month.

Lister ruled the building permit application violated the Amish’s constitutional right to freedom of religion.
