A Marshfield-based construction company will pay $12,000 in penalties to the state to settle a lawsuit.

Don Nikolai Construction & Supply Inc. was accused of violating a state permit for a water pollution elimination system.

According to the state lawsuit, DNR storm water specialists discovered Nikolai had dug a trench at the sand mine. The trench channeled sediment-laden water to a nearby culvert that flowed into Rocky Creek.

Nikolai filled in the trench at the DNR’s request, but only after water from the retention pond had flowed into the creek.

The settlement was announced Wednesday.
