MARSHFIELD STUDENT'S 911 CALL TO REMAIN SECRET

A Dane County judge has refused to order the release of a 911 call made from a murdered college student's cell phone, but did require portions of a 911 call made by her fiancé when he discovered her body to be made public.

The call was made by 21-year-old Brittany Zimmerman of Marshfield.

Dane County Circuit Court Judge Richard G. Niess made the ruling in a lawsuit the Journal Sentinel and others brought in May under the state's open records law.

Court records indicate the call from Zimmermann's phone includes a scream and the sound of a struggle. The 911 operator, Rita Gahagan, has said she did not recognize the sounds of distress and did not dispatch police or call back Zimmermann's phone.

Niess said releasing the call could damage the investigation.
