It’s not unheard of that local governments should feud, but what’s happening between the Black River Falls Police Department and Jackson County District Attorney’s office is raising some eyebrows.

Black River Falls Police requested drug charges against three men after they acted on a search warrant. District Attorney Anna Becker refused to charge the men, claiming the police department did not have adequate facts and did not demonstrate a “trigger event” occurred; therefore, the search was “anticipatory” and couldn’t be used in the case.

The situation triggered a rift between the two agencies that played out in the local papers. Police Chief Don Gilberg, who believes there is enough evidence to proceed, has directed the city attorney to request the circuit court appoint a special prosecutor, seeing the D-A’s office won’t handle the case. The state attorney general’s office has backed Becker’s action.
