JUDGE COULD DECIDE ZIMMERMAN SUIT

A Dane County Judge will decide this week if a lawsuit brought by the family of Brittany Zimmermann will move forward in court.

Zimmerman, a Marshfield native, was living off-campus in Madison when she was murdered last April.

She called 911, but the dispatcher did not send police or call back after being disconnected.

Nine months later, Zimmermann's parents and fiancé sued, alleging negligence by Dane County Executive Kathleen Falk, and a former 911 dispatcher.

In court Tuesday, Falk's attorney said there was no rule or policy that mandated the county or Falk to act.

An Attorney for the family believes the case may end up in the Supreme Court.
