JUDGE SAYS PRAYER CASE CAN MOVE FORWARD

A judge says the case against a Weston couple accused of reckless homicide in the death of their daughter can proceed.

Marathon County Circuit Judge Vincent Howard made his ruling Monday.

Authorities say Dale and Leilani Neumann elected not to take their diabetic daughter to the hospital and, instead, prayed for her recovery.

The couple have pleaded not guilty and wanted the charges dismissed on constitutional grounds.

Attorneys say two Wisconsin laws could be pivotal in the case.

One says it is not child abuse to treat illness through prayer alone.

The second is a homicide law that makes no exception for prayer.
